This document is intended to establish the Terms and Conditions under which you (hereinafter the “User”) may use this website (hereinafter the “Site”) owned by OPERADORA HOTELERA BRISAS, S.A. DE C.V. (hereinafter “OHB”). These Terms and Conditions constitute a binding agreement between OHB, who is the owner of all rights to the Site. Therefore, we recommend that you read these Conditions carefully.

Simple use of the Site implies full acceptance by the User of these Terms and Conditions. If you do not accept these Terms and Conditions or any part of them, you must not use the Site; in such case, we ask that you refrain from doing so. You also represent that you are of legal age and in full exercise of your faculties and rights to use the Site.

The user shall be fully liable for any damages caused to OHB as a result of use of the Service in breach of any provision set forth in any section of these terms of use, and agrees to hold harmless OHB and/or its affiliates or subsidiaries, its officers and staff, agents and representatives from any liability that may arise from such breach by the user, as well as from any claim, lawsuit or legal action that may be brought against OHB arising from the described facts and, in general, from any claim, lawsuit or legal action that may arise from use of the Site.

General terms of use of the Site

OHB provides the User with access to and/or use of a series of online resources and content via the Internet, including but not limited to: online text, event information, contact data, maps, promotions, trivia, image and video galleries, among others, through the Site.

OHB reserves the right to modify, add or remove, at any time and without prior notice, the Site as well as the conditions required to access and/or use it, except as set forth in the respective Privacy Notice.

The Site is for the User’s personal use only and may not be used in connection with commercial activities. Illegal and/or unauthorized uses of the Site will be investigated and appropriate legal action will be taken.

OHB will keep the User informed about events and shows; therefore, the User accepts and acknowledges that OHB may send information, notices and/or advertising through any electronic means it deems appropriate, in accordance with its Privacy Notice available at https://www.lasbrisashotels.com.mx/es/aviso-de-privacidad. Upon registration, the User accepts that all information provided to OHB is true, accurate, current and complete.

The Site may not be used in any manner not expressly permitted by these Terms.

Intellectual and industrial property rights of the Site and user contributions to the Service

The information contained on this website is the exclusive property of OHB. This information is confidential and must not be copied, distributed, disclosed or revealed without OHB’s prior written authorization.

Total or partial use and/or reproduction of the information contained on the site by any verbal, written or graphic means (mechanical or electronic), known or to be known, in any form or for any purpose, without OHB’s prior express written authorization is prohibited. Any total or partial use and/or reproduction of the information contained on this site without OHB’s authorization may constitute a violation of applicable Mexican law.

The information contained on this site includes various trademarks that are the sole and exclusive property of OHB, such as: LAS BRISAS®, LAS BRISAS (and Design)®, among others, which are valid and in full legal effect and are protected under the Industrial Property Law.

In case of breach of any of the above provisions, OHB shall have the right to exercise any actions, claims, complaints, reports and other judicial or administrative proceedings it deems appropriate, without prejudice to seeking compensation for damages.

Prohibited conduct

The User acknowledges and accepts that OHB may (but is not obligated to) review posted content and, where appropriate, delete it or refuse to publish it online.

The User accepts that they are solely responsible for content they publish on the Site or transmit to other Users. By posting content in any area of the Site, the User represents and warrants that they have the right to grant OHB an irrevocable, perpetual, non-exclusive, worldwide, fully paid license to reproduce, distribute, publicly display, perform, or otherwise use the Content, and to create derivative works or incorporate the Content into other works, as well as to grant and authorize sublicenses for all of the foregoing.

The User represents that they will not post illegal or prohibited content and will not violate, misappropriate, infringe or contravene any third-party right (including, without limitation, any intellectual property and personal right) on the Site.

The User shall refrain from any conduct in use of the Site that infringes the rights of third parties.

In particular and without limitation, the User shall refrain from the following through use of the Site:

• Not to introduce or disseminate racist, xenophobic, pornographic content, content advocating terrorism, or content that violates human rights.
• Not to introduce or disseminate on the network data programs (viruses and harmful software) that may cause damage to the access provider’s computer systems, its providers, or third-party Internet users.
• Not to disseminate, transmit, or make available to third parties any information, element, or content that violates fundamental rights and public freedoms recognized constitutionally and in international treaties.
• Not to disseminate, transmit, or make available to third parties any information, element, or content that constitutes unlawful or unfair advertising.
• Not to transmit unsolicited or unauthorized advertising, promotional material, “junk mail,” “chain letters,” “pyramid schemes,” or any other form of solicitation, except in those areas (such as commercial spaces) exclusively intended for that purpose.
• Not to introduce or disseminate false, ambiguous, or inaccurate information and content in a way that misleads recipients of the information.
• Not to impersonate other users by using their registration credentials for the various services and/or content on the Portals.
• Not to disseminate, transmit, or make available to third parties any information, element, or content that violates intellectual and industrial property rights, patents, trademarks, or copyright belonging to the Portal owners or third parties.
• Not to disseminate, transmit, or make available to third parties any information, element, or content that violates the secrecy of communications and personal data legislation.

If the User breaches these Terms and Conditions, OHB may deny or withdraw access to the Site immediately.

• Not to disseminate, transmit, or make available to third parties any information, element, or content that constitutes unlawful or unfair advertising.
• Not to transmit unsolicited or unauthorized advertising, promotional material, “junk mail,” “chain letters,” “pyramid schemes,” or any other form of solicitation, except in those areas (such as commercial spaces) exclusively intended for that purpose.
• Not to introduce or disseminate false, ambiguous, or inaccurate information and content in a way that misleads recipients of the information.

If the User breaches these Terms and Conditions, OHB may deny or withdraw access to the Site immediately.

Consent

The User, who is in full exercise of the capacities granted by applicable Mexican legislation, expressly consents to be bound by the content and scope of these Terms of Use; therefore, the User acknowledges and accepts that each time they use the Site they reaffirm and confirm their consent to this instrument and/or to the latest published version thereof.

Personal data

In some cases, within the Site, the User may be explicitly asked for information that personally identifies them (hereinafter “personal information”) such as name, address, email, telephone number, etc. This information will be necessary for users to access certain features of the Site.

OHB is not responsible for the accuracy of the information, as it is information provided by users who access this website.

OHB also reserves the right to exclude from use of the Site any user who has provided false data, without prejudice to other actions that may apply under law.

Applicable law and jurisdiction

By using the Site, the user expressly agrees to submit to the jurisdiction of the competent courts of Mexico City and to the applicable laws in force in that place in case of any dispute, expressly waiving any other jurisdiction that might apply by reason of their nationality or domicile.
